Seller

The seller is the company identified in the block above. It provides an online service to create, host and manage websites.

Professional customer

The service is offered exclusively to persons acting in the course of a business (company, sole trader, independent professional, association carrying on an economic activity). Before subscribing, the customer confirms the professional status declaration.

The customer confirms that the subscription is taken out for the purposes of that business and that they are responsible for the legal, administrative, social, accounting and tax obligations that apply to them.

Description of the service

The subscription includes: creating the website with the assistant, hosting and publishing it at a webopen.ai address, the editor, the contact form, simple statistics and a monthly allowance of credits for the artificial intelligence features.

The exact content of the offer is the one shown on the pricing page at the time of order.

Free trial

The subscription starts with a 7-day free trial. The payment method is registered at the start of the trial. Unless cancelled before the end of the trial, the paid subscription starts automatically when it ends.

One trial is granted per customer.

Prices

Prices are in euros, excluding VAT: €12 per month or €120 per year.

The seller may change its prices for the future. A change only applies from the next renewal, after the customer has been informed.

Taxes

The service is sold exclusively to professional customers. The customer's professional status is established by the professional status declaration signed before subscribing, which is the basis of the tax treatment described below.

All prices are stated excluding VAT. The seller does not charge VAT. The reverse-charge mechanism applies (Article 196 of Council Directive 2006/112/EC and equivalent provisions of the law applicable in the customer's country): the customer is liable for any VAT due and solely responsible for declaring and, where applicable, paying it in their country.

No tax identification number is required to subscribe. The customer may add their number (VAT number or tax ID) in their billing details. Invoices are issued without VAT and bear the mention “Reverse charge” (Article 196 of Directive 2006/112/EC).

Payment

Payment is processed by a payment provider. The seller does not store full card details.

The customer authorises the charge of the subscription price at each renewal date until cancellation.

Term, renewal and cancellation

The subscription is monthly or yearly and renews automatically for the same period.

The customer may cancel at any time from their dashboard. Cancellation takes effect at the end of the current paid period; the website is then taken offline.

Refunds

The service is a digital service supplied immediately, between businesses. A period that has started is not refundable as of right.

The seller may grant an exceptional refund, in particular in the event of a technical failure attributable to it.

Failed payments

If a payment fails, the seller may retry the charge. After 14 days of non-payment, the website is taken offline and no longer indexed. Data is kept for 90 days, then deleted.

Content published by the customer

The customer is solely responsible for the content of their website: texts, photos, prices, reviews, contact details. They warrant that they hold the necessary rights and publish accurate information.

Prohibited content includes illegal, misleading or infringing content, phishing, fake reviews and impersonation. The seller may suspend without notice a website that is manifestly illegal or validly reported.

AI-generated texts

Texts suggested by the assistant or by artificial intelligence are suggestions. The customer reviews them and remains responsible for their accuracy once published.

Availability

The service is provided on a best-efforts basis and may be interrupted for maintenance, security or technical reasons.

Liability

The seller does not guarantee any level of traffic, contacts or search engine ranking.

Subject to mandatory provisions, the seller's liability is limited to the amounts paid by the customer in the twelve months preceding the event giving rise to liability.

Personal data

Data processing is described in the privacy policy. For messages received through the contact form of their website, the customer is the controller and the seller acts as processor on its behalf.

Governing law

The governing law and competent courts have not yet been formally decided by the seller; they are therefore not stated here rather than asserted without verification. The parties will first seek an amicable solution through the contact address.

Translations of these terms and of the other WebOpen Sites legal documents are provided for convenience; in the event of any discrepancy, the English version prevails.
